Captain Nurse Circle Needs “How to Access and Use” Labels on Our Fire Extinguisher Cabinets!

Nothing happened his week. The fire extinguishers and cabinets were not serviced as I was told they would be by Andy, the owner of the North Cal Fire Equipment Company…Just updating here and keeping track of this situation…

UPDATE 10/08/15:

Just received a phone call from Andy, the owner of North Cal Fire Equipment, LLC. This is the company that maintains our fire extinguishers here in Meadow Park… He told me that labels have been ordered for all the fire extinguisher cabinets on Captain Nurse Circle and will be installed next week!

I say this is a victory for me as it  seemed nearly impossible to have this important safety feature addressed properly on our fire extinguishers here on Captain Nurse Circle… It was only due to my persistent blogging and emailing that this has finally resolved the right way…I remain the Fire Safety Committee of one for Meadow Park homeowners…

UPDATE 09/28/15:

One year ago, in September 2014, I made a very important post concerning our fire extinguishers. Now, we are due for the yearly inspection and maintenance of these fire extinguishers…Thankfully, there has not been any fire emergencies on my street… But, the fire extinguisher cabinets remain unlabeled and locked up and we do not have access to the keys… I am making this update here and now and putting it on the front page of my blog so others can be informed about this… It is something that the management of our HOA has chosen to ignore.. In fact, I was told this in an email from Wakefield Sharp:

“The Board of Directors for Meadow Park has considered the cost and currently
allows homeowners interested in replacing stickers on fire extinguisher
boxes to do so themselves.”

First of all, I am not sure that the Board of Directors really discussed this at all..Many times Wakefield Sharp has made important decisions without consulting the Board… So I do believe this is an outright lie…

Secondly, there is nothing to replace! The labels were never installed initially.

What a bad property management company this is! Do we really want them to continue here? No way!

I am not doing anything except posting the reality that our fire extinguishers remain non user-friendly.  I am not responsible for a poorly installed fire extinguisher cabinet. Other fire extinguisher cabinets located in the Meadow Park community are properly labeled but not the ones here on Captain Nurse Circle!

A poor installation was allowed to occur and never got fixed….

All fire extinguishers in Meadow Park should be at the same level of use… And this lack of equality is happening still…A very poor management company is trying to put this on the homeowners… We are not to be blamed for this.. It needs to be fixed and done right…

Now that the HOA is in the fire safety mode (finally!), I am bringing up another issue that I discussed  last year here on my blog:

That post was made in September 2014, over 5 months ago and nothing happened!… Our fire extinguishers are checked and replaced every year. This is a law here in California, USA. What I found last year was that there is a big difference in the labeling of the fire extinguisher cabinets here in Meadow Park. For example, our locked fire extinguisher cabinets here on Captain Nurse Circle do not have any labeling which shows how to easily access the locked fire extinguisher in an emergency. This is what they look like here on Captain Nurse Circle:

But, all of the fire extinguisher cabinets in the other five Meadow Park neighborhoods have labeling on the cabinets. See below:

The Fire Marshal kindly shared with me by email what the label looks like and although he said this is not a state requirement to have these cabinets labeled, the Novato Fire District highly recommends that the cabinets be labeled.. This never happened! I am bringing it up again because it needs to be done right….We need to have this labeling done on our fire extinguisher cabinets here on Captain Nurse Circle ASAP…

So, I sent an email to the fire extinguisher company (North-Cal Fire Equipment LLC) yesterday. It is important that our fire extinguisher access is at the same level as other neighborhoods in Meadow Park and right now, we are at a clear disadvantage…Here is the business card from the technician (Frank Stagnaro) I spoke with last year:

And, in an emergency it is vitally important to have this labeling easily and readily available. In an emergency, you do not want to try to figure out how to open the fire extinguisher cabinet to access the fire extinguisher. But here on Captain Nurse Circle there are no instructions or labels as of this day, 02/10/15,  and we discussed this problem almost 6 months ago.

This photo was taken by the Property management company of another extinguisher located in the complex. NFD has spoken to the property management regarding the code requirements and the options that they have regarding this situation.

Although this one has a sign on it with instructions on opening the cabinet, it is not required by code to be installed. We are recommending that they install signage on all of the cabinets.

Now, I am hoping that this problem will be taken care of in a very responsible and expedient manner. It has been a problem for way too long and was never done correctly since the initial installation. As with other areas of fire safety concern, this is one more little problem that can easily be cleaned up with the cooperation of the HOA management.. I hope that it gets done right this time and soon…

Even though the California state law DOES NOT REQUIRE  locked fire extinguisher cabinets, here in Meadow Park, ours are locked! So either UNLOCK them or LABEL them, do something please!

Jensen Landscape Maintenance Company Mishandles Landscape Irrigation System Testing on Captain Nurse Circle- Sprinklers Left On Over 9 Hours!

I am posting this also as a page so that it is easily seen and viewed by the public. I want to make sure the public is aware that this incident occurred on Captain Nurse Circle. I am hoping that we were not made to pay for the extra high water bill as a result of the landscape company’s  negligence when they tested the sprinklers in April….Jensen should have paid this bill, not the Meadow Park homeowners…

UPDATE:

AT 7:39 PM, 04/03/15, the sprinklers behind buildings 2 and 4 on Captain Nurse Circle were finally turned off…It took Jensen over 2 hours to get here after they were first notified… And of course, they act like it is no big deal, a “stuck” valve.. Well, why didn’t that get detected this morning? Since the sprinklers were all being tested, these sprinklers should have been turned off manually before the worker left our street. Instead, these sprinklers behind my building 4 and building 2 were not checked at all.  They were just left on, since about 10AM.

If they had checked the sprinklers and found a stuck valve at 10 AM, then it would have already been repaired….But, since they (Jensen) did not do their job, they allowed over 9 hours of continuous irrigation! And this was not just one sprinkler but MANY!…

Poor excuses and low marks for this new landscape maintenance company that was just approved in January by the Meadow Park HOA Board of Directors as our new landscape maintenance contracter…I wonder what other “mistakes ” are being made by them?


04/03/15  5:15 PM:

This morning, the irrigation system was finally turned back on for my building. They were testing the sprinklers.  I noticed how quickly Jensen did this. They just switched them on and off very quickly without doing a walk around to visually see if they were all working.. That was mid morning, 04/03/15. I noticed just now as I went to back of my building that sprinklers were left on behind and in between buildings 2 and 4. It is now 5:16 PM. So this area of sprinklers were not manually turned off during the sprinkler inspection. The Jensen people were negligent this morning and left these on….

Now this is a horrible mishandling of our irrigation system and a huge waste of water  that these landscape maintenance people from Jensen caused. They did not do a thorough job at all to see if the sprinklers were on or off, and as a result, our water bill is going to be way up there at no fault of our own. When irrigation systems are tested, there must be accountability for the system to be turned off properly.. This was not done today by Jensen. They were totally negligent in their follow-up of the sprinkler testing on Captain Nurse Circle…

I called Jensen myself and found their emergency number to be: 707-249-4164. I called them at 5:18 PM and left a message and still no response at 5:40 PM. I also made a valid work order to Wakefield Sharp about this incident. This is what I reported to Wakefield Sharp:

“I am reporting that a big problem happened today with the irrigation system here on Captain Nurse Circle. It is now 5:15 PM and I just went in the back of my home and noticed the sprinklers are still on behind building 2 and in between building 2 and 4. These were initially put on late morning. This is not good….I contacted the Jensen after hours emergency number just now at (707) 249-4164 and I hope that he responds and turns these sprinklers off.. I am sending this to you as documentation of my work order..We should not be paying for this big mistake by Jensen…All those guys did was a quick test of the sprinklers and no follow-up and now a big irrigation bill has been caused by their negligence…”

I also called Wakefield Sharp’s after hours number (415-382-1100) and left a message regarding this landscape irrigation emergency…

I even contacted one of the board of director’s, Treasurer Roger Burstrem just now because he lives right across the street from me. I told him about the irrigation problem. I told him I do not know how to turn off the sprinklers and he said “No, you should not do that”……

This is such a sloppy job and very irresponsible of this Jensen company. I am reporting this now because I want it well documented that it happened and is still going on right now at 6:44 PM. Those sprinklers are still on behind and in between buildings 2 and 4 on Captain Nurse Circle. Come on over and take a look for yourself!

I do not know when they will be turned off. I did as much as any responsible Owner can do in this situation. I have no idea how to turn off those sprinklers…. And I am not going to even try. I am simply telling everyone what is happening right now…

Maybe Jensen is not the right company for us. They immediately used herbicides everywhere and did nothing more that. I do not like how they do things…They seem to love those mowers that they ride around on more than anything else…They are irresponsible with our irrigation system! And in this drought time too, this cannot be tolerated one little bit..

THEY ARE OUT OF TOUCH WITH REALITY!…Really, Board of Directors, is this the right landscape maintenance company for us?They  are costing us a lot of money, way more than $16,000.00 per month. Look at those water bills go sky high…

 

Illegal Renting Continues on Captain Nurse Circle…But Now (Maybe) There is Some Action!

I just received a very nice follow-up email from Eric Lucan, Novato City Council Member. He was checking on the status of this situation and wondered if the City had been in contact with me yet… Thanks so much Eric for all your concern and support! I informed him that Bob Brown had just emailed me about the upcoming November 17 meeting information…

How fortunate I am to have these City of Novato officials on my side… It sure feels good to know that the City of Novato is taking care of Meadow Park! And BTW, you have my vote for sure Eric…I like what you do and I agree with you too!

I just received the best email from Bob Brown, Community Development Director for the City of Novato.  Here is what Mr. Brown told me:

I received a forwarded copy of your recent e-mail regarding the renting of affordable housing units at Meadow Park.  City staff, along with Hello Housing, have been continuing to receive homeowner/occupant verification information from the great majority of homeowners, but there are some who have not replied and may be actively renting their units.  We are pursuing final investigative steps to obtain sufficient evidence to initiate legal proceedings for those we believe are in violation of their purchase documents.  We will describe our enforcement process and timeline at the next HOA meeting on November 17, 2015.

“Regarding the enforcement of owner occupancy in Meadow Park, we have established an approach to take with out of compliance homeowners in partnership with the City and will be publicizing our efforts in the next few weeks.”

Just had a nice stop by visit from Eric Lucan. He was distributing his re-election flyers door to door and rang my doorbell. I was happy to finally meet him in person and hear what he had to say… He told me that he did forward our emails to the City Manager’s office.. That is a very good thing!

Now there will be some action toward correcting this situation… Inactivity is a thing of the past… Because Eric took a genuine interest in my concerns, we will see legal actions occurring … And I know Eric will do a fabulous job when he is re-elected for Novato City Council…

UPDATE 09/14/15

Just had some emails and a phone conversation with Eric Lucan, Novato City Council Member, regarding this problem…I told him that I have not seen any legal follow-up as of yet, and I still see illegal renting continuing on Captain Nurse Circle…

He is definitely looking into it since the city council did authorize Hello Housing to intervene last October.. He is going to let me know what is happening right now… Thank You Eric!

I still have not heard back from Matt Warner of Hello Housing.

UPDATE 09/07/15

Just received that very nice looking newsletter from Hello Housing stating that renting is not allowed here in Meadow Park…Well, I am still seeing illegal renters living on  my street…Where is the legal action I was told would happen four months ago from Matt Warner of Hello Housing?  I am not seeing any legal action…. Apparently, there are 3% of responses still not received by Hello Housing regarding owner occupancy… And I know why… That 3% are the homeowners still renting their townhouses illegally because they are not being stopped

That is what is currently happening…Many of those homeowners own townhomes right here on Captain Nurse Circle… It is like this little negative sub-community that has set up illegal renting and this activity is being enabled to take place….

The City of Novato and Hello Housing are not doing anything about it…. Wait and wait for nothing to happen…I see the illegal renting activity going on all the time and document it here on my community blog. That way the public can know what is really going on here in Meadow Park.. This problem remains a big mess and has not been addressed legally at all! How long does it take for something to change here? A year longer? Five years? What is the wait for? Why is there illegal activities still happening all the time? Why? Today, I emailed Matt Warner again to get an update and no response…

That is the latest information available about the illegal renting happening on my street: Captain Nurse Circle. The good news is that it is being actively investigated and dealt with this year! And that knowledge should improve our home property values even more!

You will only read about this here on my blog. The Meadow Park Board of Directors and management do nothing about this and never talk about it at any board meetings…. I hope this sends a severe warning to the renters and Owners who rent in our Meadow Park community. Beware! You are not being over-looked anymore. The City of Novato is aware of your illegal renting activities and is following through legally now…. And the proof is right here on my blog. I just posted Matt Warner’s email.. We are not a rental community.. We are a community of Home Owners!. We could not qualify for a home here based on a renter giving us income.. Our CC&Rs prohibit renting of any kind…Our CC&Rs govern us.. We have more restrictive rules than the City of Novato.. We are protected from renting situations by our CC&R 3.2…

3.2 Owner Occupancy Requirement and Renting.

Pursuant to the terms of the Affordable
Housing Covenant, Resale Restrictions and Option to Purchase Agreement (the Resale
Restrictions Agreement), the Non-Transitional Housing Condominiums must be Owner-occupied
and may not be leased, subleased, or otherwise rented.

Now that this problem has been brought out in the open (by me) it is being dealt with by the proper authorities..

It is hard to believe that this much time has passed since I first posted about this problem.  It has though and I decided this week to find out what was really going on here… I still see the illegal renting activities going on unabated.. It seems like nothing has been done to stop it…But maybe there is some progress and I would like to post about there…

So I sent Matt and Mardie at Hello Housing a new set of emails to try to see what if any progress has been made. I have not received a response from either of  them…

That is not good of course.. Hello Housing is the agency that is supposed to oversee this problem and make sure it is corrected… But so far, no response from either one of them. I made a note here today because I am trying to follow-up on these illegal renting issues since no one else is doing this….

The illegal renting problems go on and on…Property values go down when this happens.. It is not a good situation here on Captain Nurse Circle….

I hope to hear from one of them soon….

I have not heard any more from Matt Warner of Hello Housing. He assured me that he was working with the City of Novato to deal with this problem. Well, the problem continues over one month later. The wrong people are here on my street walking around with their assistant acting as if they belong here. The white buses still come and go as if it is OK. It is not OK. I still see foster teens everywhere. How did this happen? Who is allowing our renting restrictions to go on unchecked.The Meadow Park Board of Directors is allowing this mess to go and on….

I emailed Matt Warner again after talking to another Owner here on Captain Nurse Circle last night because I can tell nothing has changed for the good. I am not happy. I am really disgusted. I am thinking a court action may be necessary if things do not change soon…

It was over one month ago that you replied to me about the illegal renting situations on my street: Captain Nurse Circle in Novato. It continues Matt. I am disgusted to still see these DD people being picked up in those big white buses everyday! I am also disgusted to see them being walked around my street with their assistant acting like they are supposed to be living here. I am just giving you the most recent update possible.
I hope you can start notifying these derelict owners about their illegal activities. I am sick of them getting away with it….There is another Owner on my street too who has illegal rental concerns. Her name is Corrine Mills and she said she spoke to you about this at the meeting you had here in Meadow Park a few months ago. But she has not heard anything else either and still sees the illegal renting problem persist. Do we have to go to court to get this settled properly? I hope not. 
Please, do something now and inform me what is going on. I am blogging about this on my blog site so that Owners know what is really being done this time to get rid of the illegal renting problem…It is still totally out of control

Four months ago I made this post to continue documenting an unsafe and extremely high fire hazard situation in my neighborhood.. I am reporting again that nothing changed the right way... Instead, I see the HOA authorizing more high fire hazard wood chips described as “mulch” spread all over our landscape… The trees that are very volatile and dry with peeling bark and dead branches remain here untouched. I am referring to the Eucalyptus and Paperbark trees of Australian origin.. These are non-native high fire hazard trees allowed to remain in my residential neighborhood… There are way too many of these trees here.. All of them should have been removed a long time ago!

And yes, we have rules against this, but the rules are being ignored still.. Sadly, the HOA is in the dark ages still… Hiring an outdated landscape maintenance company like Jensen to do things the old-fashioned way: using herbicides and chopping down all of the living and growing healthy and low fire hazard vegetation.. Oh, and I also blogged about the time they left the sprinklers on for over 9 hours…..I reported that water wasting incident to the North Marin Water District…I sure hope we did not have to pay that water bill…

Why are these landscapers still here? Good question…

I observed a very bad “landscape maintenance activity” yesterday in my neighbor’s exclusive use common area landscaping attached to her front patio… This landscaped area is the homeowner’s responsibility to maintain, not the HOA’s! A landscaper from Jensen used his power tools to chop down a very healthy and thriving Jasmine vine.. It looks like a war weapon hit it… It was so beautiful and fragrant.  This plant is allowed according to our vegetation rules….Now it looks like it is barely alive….

This is a disgrace..

And these people at Jensen should all be fired and replaced with a good group of organic landscapers … That is where we are right now in much of the country… No one likes the fact that they are using herbicides whenever they feel like it…With no thought given to the people and animals who live here…Disgraceful! But here in Meadow Park, Jensen took over from Cagwin & Dorward and continued doing things wrong at a very high price.. These landscapers cost us $16,000.00 per month.. What a horrendous waste of money that is….We are constantly being overcharged by the HOA because the landscape maintenance company is being told to do all of the landscape maintenance! Even the part that is the homeowner’s responsibility…

What a bunch of idiots these management people are…But their time is ending soon….

I have blogged about this problem so many times!  I am stating this here for documentation purposes that the management of this HOA has not fulfilled its responsibility. It has not adhered to the Meadow Park Vegetation Management and Fuel Modification Plan Phase One (hereafter to be referred to as the Plan) which prohibits these types of trees on our street….Phase One refers to Captain Nurse Circle and March Field Court, (according to the map included in this Plan). These trees are strictly in violation of our Plan….

Nothing was ever done to make sure that these high fire hazard trees on our street were removed no matter how many times I notified the HOA management and complained….NOTHING! I have contacted every authority available about this situation and got the complete run around…The City of Novato was responsible at the get go for making sure the Plan was in place and the neighborhood was ready for homeownership .. The City of Novato failed to do this…These trees were allowed to stay here in direct violation of our Plan!

The Australian Paperbark trees are in full bloom and doing quite well… This tree is high fire hazard, invasive, and non-native. It is a very bad tree for our landscape.. Why is it here? Many states in the US are prohibiting it altogether.. It is not good to have these trees here….Yet it is in high-profile right now and in full bloom with its white bottle brushes because the Novato Fire Marshal called it a California Pepper Tree.. I know the difference between those two trees… I am not stupid..

And that huge Eucalyptus tree remains in the center of Captain Nurse Circle. This tree has been there since the early days and was left there when our homes were built. Does that make any sense at all? Why wasn’t it removed before our homes were built? Who decided to leave this high fire hazard, prohibited tree in the middle of our street? There are other Eucalyptus trees here too… It is a crime, do you understand!…All these bad trees lined up in the middle of our street:. the Paperbark and Eucalyptus make our street in danger of a fire ..It seems like these people want us to have a fire here.. That is what it looks like to me…A set up for a fire disaster…

So, that is all I am saying one more time.. These trees remain here and it is in violation of our rules, especially the Plan, Phase One.. which was developed many years ago to protect the homeowners here on Captain Nurse Circle…These people and agencies: the City of Novato, the Novato Fire Protection District, and the Meadow Park HOA Board Members,(including Wakefield Sharp Property Management) have failed to provide a safe living environment ..These people and agencies continue to ignore the reality of this construction tragedy that was never properly handled… And still is not being corrected to this day! This is a scam, a sham, a complete disgusting mess and it needs to be talked about openly.. So I am here to do it, over and over again until positive change occurs..

THE PLAN WAS CREATED AND SIGNED OFF BY THE NOVATO FIRE MARSHAL OVER TEN YEARS AGO BUT NEVER PUT INTO ACTION!

This blog post describes the slow progress with Meadow Park’s 5 year fire sprinkler system certification inspections which were completed in March 2015 by Exxell Fire Systems of Oakland, CA… Our Meadow Park community has been in existence for over 10 years but this is the first time we have had any fire sprinkler system inspections on a community wide basis…Over 200 of our homes still need corrections in order to become certified….Many of the Meadow Park Owners did not set up an appointment to let the Exxell contractors inside their homes to inspect the fire sprinklers and escutcheons……I continue to update this blog post as information becomes available directly from Exxell Fire Systems.

UPDATE 08/06/15:

Still no word. No news. No corrections appointment… It has become a big joke… All of this work that was done to inspect our fire sprinkler systems and get them all in good working order is now at a complete standstill… And so many problems were detected on our fire sprinkler systems too… Many of the problems apparently had to do with an installation error… But are we (the Meadow Park owners) getting any word back from the Board or the property management company, Wakefield Sharp? Are we getting things repaired in a timely manner? No! We are just sitting here waiting and waiting for something good to happen…That is what is going on right now at 11:15 AM on August 6, 2015…Nothing!

UPDATE 08/04/15:

It was almost 6 months ago that my fire sprinkler system was inspected  by Exxell Fire Systems…. There has been very little progress made with the corrections… I checked in with Nate at Exxell Fire Systems today to see what was going, on if anything…He said he is not aware of what was going on either. He sent them (Wakefield Sharp) that SAME question one week ago and they never responded… He is following up now with another email to them TODAY..

I told Nate this is a very good example of the extremely poor customer service  from Wakefield Sharp that we have to put up with here in Meadow Park…..They never even responded to Nate at Exxell Fire Systems… Can you believe it? What a bunch of bad people they are at Wakefield Sharp…

AND THE WAITING GOES ON AND ON TO HAVE OUR FIRE SPRINKLER SYSTEMS REPAIRED….

UPDATE 07/29/15:

I emailed Nate at Exxell Fire Systems to give him the most current information about the installers of our fire sprinkler systems… He said thanks and will pass it along…..I just felt is was important to give this information to him as this issue may be very tricky right now as installation problems were found during this inspection… I hope this speeds things along.. It took me awhile to find this installer…I wanted the Board to have the name and contact information of the installer… That is all I am doing… I did this research over one year ago and it seems to be pertinent now…

On 7/25/15 I received an update from Nate at Exxell Fire Systems today…

“An update for you. There is a key part missing from most sprinkler systems. The Board is debating to see the best way to handle this. They are trying to determine if it gets put on all systems or just the ones we need to correct. I’ll let you know when a decision is made.”

Last year in June 2014 I researched several sources to find out the contractor who did the initial fire sprinkler installations for Meadow Park. I finally got an answer from a Centex agent on June 10, 2014. Here is the response:

This new company is located in the Sacramento Valley area….I never contacted this new company…That is something that the Board members should do if there was a problem with the initial installation…

I told him I am just patiently waiting now for my corrections appointment, as are the over 200 or more other Owners here in Meadow Park… And that is all I am doing about this situation now. It is in the Boards’ hands, not mine….

I will continue to post here any further information as I receive it. I am not making anything up. I only post the exact words and the truth.. That is all you will ever read here on my blog…I am not into sensationalism as other bloggers are.. I just report information that is truthful and not fantasy… You can get lies and fantasy in the other mainstream news of the day… I post reality only


I am hoping that all 351 homes were inspected inside and out….That is a big question in my mind…How many homes here in Meadow Park actually were inspected? I was told that all of the outside equipment was tested on every building, but not all of the interior systems (i.e. sprinklers and escutcheons) were inspected… Hmm. I guess the Owners were not being cooperative with this? That is not good! I wanted all Meadow Park townhouse fire sprinkler systems to be thoroughly inspected inside and out..

That is what the Board wanted too. The board meeting minutes from November 18, 2014 state:

“The Board reviewed estimates from three contractors before the motion was made seconded and passed unanimously to approve the proposal from Exxell Fire Systems at a cost of $46,360.00 to inspect and supply documentation on the fire sprinkler systems and alarms for each unit in Meadow Park. The Board instructed Management incorporate the expense in future Meadow Park Reserve studies.”

A meeting was being scheduled (supposedly) so that the Meadow Park Board of Directors can listen to the inspection findings report and approve the correction costs…Apparently Exxell Fire Systems has been trying to set this meeting up for some time and has been told no several times by Wakefield Sharp Property Management..Hmm. Well, I am not surprised here. Wakefield Sharp has not been an advocate of this inspection at all and they are undermining the progress here… There should have been a meeting on this months ago…And now it appears that a meeting was never held…On June 10, one month ago today, Exxell Fire Systems was told that a meeting was going to take place… Wakefield Sharp was supposed to set this up but never did… So, Exxell Fire Systems is just sending them a new contract for the corrective work that needs to be done on the 200 plus units….

Exxell Fire Systems wanted to meet directly with the Board to discuss this matter, but it was not handled properly at all.. Several requests were made and ignored by the property management company Wakefield Sharp…

Now this is going to cost us some money… but other HOAs have done this too, even reaching into their reserves to cover the cost.. I do hope that the Meadow Park HOA Board of Directors sees the importance of this and understands that there have been other HOAs like ours doing the same thing because it is so important to have this done community wide…. It is now our turn to finish what we started….

I will continue to update this situation as more information becomes available…

I told Nate that I am not too sure that his request to have a face to face meeting was ever really presented to the board members… I have a feeling Wakefield Sharp intervened here and stopped that whole thing from ever happening….I am waiting to see what happens after Tuesday’s meeting.. It will be interesting to see how this whole thing plays out in reality….Exxell Fire Systems can attend the meeting and be present when this matter is discussed. I want to make this totally clear that they have been fully informed… If it were me, I would definitely be there, considering the situation and circumstances… It is a good thing I do not have to be there though… All kinds of strange things would happen. Really, these excuses are INCREDIBLY boring… And to say it may take up to three years to get it all done is outrageous…

Get the job done now… We need to be five-year certified here in Meadow Park… That is what you were hired to do… Not prolong it and allow  us to continue at a high fire hazard disadvantage. That is too scary!
We are five years overdue for our certification..We have been here over ten years and this was never done before… That is why there are so many problems…
Maybe you are not the right company for us after all…That is what is seems like… There are so many fire safety companies out there… I am not sure why you were even chosen…I had spoken with another company which I really liked. I was the one who got this all started. You don’t seem to even realize that..That guy even came out  on site and gave me an estimate which was so reasonable…I turned all that paperwork over to the Board but they picked you guys instead….I gave him a map plan of our community so that this could be done neighborhood by neighborhood.. Easy….You guys seems to be so unorganized…
When we had our buildings painted, even the painting company knew how to organize a project like this.. Yes, they had to come into every home to paint the front door.. Now that was done quite easily.. And in a  totally organized fashion..You do not seem to know how to handle our project.. It appears that you are stuck…And the painting was not even a state law requirement!  This is! And you still act like you cannot handle it….And that painting project was extremely expensive too…They had to do lots of extra repairs etc….
The Board of Directors does not meet again until the third Tuesday in July! Are you going to just wait and wait? You were not even on the agenda at the last board meeting.. The management  company is trying to cover everything up…. I told you how to get this going… You are still slowing everything down..If you are not getting cooperation, you can contact the local fire marshal. You can also call an extra board meeting ASAP to get this addressed and then attend in person!… Be proactive or leave! It is a state law remember? We need to have this done… It is an extreme safety hazard to let it go as you are…
We are not getting the kind of service that we expected… And meanwhile we are all hugely out of compliance here in Meadow Park because of a “contract issue”…
And many of us are very uncomfortable too because we know that our systems need repairing … And in this drought time, I would think you guys would be extra fast at cleaning this mess up…We are all at a high fire hazard situation here in Meadow Park.. That is why I took this problem on.. NO ONE ELSE WAS DOING ANYTHING!! GET IT!!!
 
The Board did this only  because of my community activities and emailing and blogging and that is the truth…And the management company does not like it either.. So you are not getting any help from Wakefield Sharp.. They do not like that our money is being spent this way… but they are not in charge of our money…That is the reality..Wakefield Sharp is just  hired help… 
 
This is a state law and the Board approved it..Act like you have more control and you will…The money is there,  believe me…And it is not a negotiable item.. The repairs must be made ASAP.
I will continue to blog about the current situation here in Meadow Park.. And the non progress with our corrections…
It is out in the public arena and it will not stop being there ….
That is the only way I have made things change here.. By speaking out in the open and telling the truth..

I’m sorry, Miles is back and forth with the Management company, we cannot legally do anything without the ok from them. We were only contracted to do any corrections. I have no control over anything myself currently it’s all over to the other company. Blog all you want because it is messed up, and I’m getting many emails about the corrections, but we have rules we need to follow and we are trying to make it as affordable as possible. I’m sorry for the wait but we still cannot do anything until another contact is worked out and singed. SO, it’s the management company (Wakefield Sharp) that is standing in the way… I will post this on my blog.. perhaps things will change… After all, it was theMeadow Park Board of Directors who approved this contract. The Board of Directors is composed of homeowners like me.  The management company is just a hired company like you…The management company has no power over contracts! Be very careful here ….I hope you understand the difference here…The management company has to do what the Board says… That is the truth …

That management company, Wakefield Sharp is a bunch of criminals and needs to be fired….

This is not acceptable at all…And still no response to my emails this week… Bad business practice here… I am not happy and I am blogging about it…How patient am I supposed to be? This is unreasonable and no one is doing anything about it… So I continue blogging and show how bad this whole situation really is…This company should have been organizing the inspections and corrections from the very beginning… Four months is long enough to be completely done with everything!

I am still trying to get my appointment set up for my fire sprinkler system repairs.. I am not getting very far… I have sent 2 more emails and left another voice mail message…One of my emails came back as undeliverable. I have not received any response as of today 6/08/15 at 10:00 AM.. I am just documenting this here on my blog because this is so unprofessional…. I cannot believe that it was four months ago that my fire sprinkler system was inspected… Four months!!! And I was expecting the repairs and a certification report by this time…Four months to wait for repairs is unacceptable…

I am not being unreasonable.. I am only stating the truth. Now I am just waiting like the rest of the Meadow Park homeowners for some kind of action here…

This has not been a smooth process and continues to be treated like it is non-important.. It is in fact extremely important..The HOA Board of Directors approved this inspection six months ago and as of this date we still do not have our fire sprinkler systems repaired!!!

It was on February 9, 2015 that I had my fire sprinkler system inspected by Exxell Fire Systems (http://www.exxellfiresystems.com)… I have been in close contact with the employees there since that time..The reason I am doing this is because I want to make sure that I receive my final five-year certification report.. This is a state law!

Owners have to have this inspection done every five years here in California.. And as I have lived here in Meadow Park now for almost 10 years (June 27, 2005 was my move-in date), this inspection was never done and is way overdue!… But because of my interventions over this past year, the Meadow Park Board of Directors approved this inspection in November 2014 for all homeowners… It was not until February 2015 that the inspections started… The inspections completed in March…. Now what about the corrections? That is the big mystery here…

 There seems to be some problems getting the corrections organized… 

So, I remain in communications with Exxell Fire Systems and wait a little bit longer while they figure out how to schedule the corrections… It will happen I know despite the lack of coordination help from the HOA management … It still happens… We are all going to get our five-year certification reports because we the Owners here in Meadow Park are paying for it through our HOA assessment fees…

It is one of the best uses yet of those HOA assessment fees.. And it is going to happen..

This is the most recent information I have about the fire sprinkler system inspection which was approved back in November by our Meadow Park Board of Directors… I am hoping that I will be contacted soon to set up my corrections appointment…I want to be in compliance with the state law.. It is time for the Meadow Park HOA Board of Directors to grow up and deal with the real important issues as I have… It is time for the Meadow Park HOA to have the governing documents on their official website. But even if they do not ever deal with reality, I always do and that is why those very important governing docuemnts will always be right here…

After one entire year of online blogging here on WordPress about Meadow Park: I  do see some positive changes occurring..

There has been some good intervention with the Novato Fire Protection District… Not enough though! The Vegetation Management and Fuel Modification Plan, Phase One has not been utilized to the extent it was intended…Sad to say, Captain Nurse Circle (Wood Glen) remains as a neighborhood in Meadow Park without fire safe landscaping, labels on our locked fire extinguisher cabinets, and repaired fire sprinkler systems…….This puts our neighborhood at risk for a serious fire emergency, especially in this drought time… I have said this numerous times though.. This is still the current status…

There is legal action being done about the illegal renting in Meadow Park.. This is a wonderful change……

I have been able to achieve an almost unheard of and nearly impossible feat: having our fire sprinkler systems tested and inspected for a five year certification, and paid for through HOA monies…..THE PROPERTY MANAGEMENT CONSTANTLY SAYS, “THIS IS THE HOME OWNER’S RESPONSIBLITY”. WELL YOU STUPID PROPERTY MANAGEMENT COMPANY, IT IS OUR MONEY THAT IS PAYING FOR IT… IT IS OUR MONEY THAT PAYS FOR YOUR RIDICULOUS AND CORRUPTED SERVICE TOO…

I am still awaiting for the repairs though… My fire sprinkler system was tested on February 9, and I still have not had the repairs done.  I hope this happens within the next few weeks…I want my 5 year certification report for my records… This is a state law…I am following up on that today… And if I receive any good news about it, I will post here….

Fire Sprinkler System Inspection And Repairs: An Update

It was about one month ago that I was last in contact with Nate Hargitt at Exxell Fire Systems. I have not heard any more fire alarms sounding here on Captain Nurse Circle. I hope that all or most of the fire sprinkler system inspections have been completed.

I want my fire sprinkler system repaired. I want my 5 year certification report too. I hope that this does not fall apart. The Board of Directors is accountable for this inspection project…

There is no board meeting until next month (Date: May 19, 2015, Time: 7:00 PM to 8:00 PM Location: Hamilton Art Center, War Room 500 Palm Drive).

Three Valid Work Orders Snubbed by Wakefield Sharp: The Hired Help needs Firing!!

I thought I would give the hired management help one more chance to prove that they are worth our money. However, I  still consider them “fired help”…

(1) I sent them a work order on 04-03-15 when the sprinklers were left on here on Captain Nurse Circle for over 9 hours and they never responded to it! I want to make sure that we Owners are not held responsible for this very big water bill that was totally Jensen’s fault…

And still we have no irrigation schedule here on Captain Nurse Circle. I am performing my Owner’s responsibility by maintaining my exclusive use common area landscaping. I water the vegetation there myself. I do not see any other Owner doing this though. I am the only one ….

According to CC&R 4.2, all owners are responsible to maintain these landscaped areas:

4.2 Owners Landscaping Obligations. Each Owner shall maintain the landscaping within any Exclusive Use Common Area patio appurtenant to the Owner’s Condominium in a healthy and weed-free condition and shall be responsible for the periodic pruning of any trees and the removal of any diseased or overgrown trees or any trees with root systems that are damaging any
Common Area or Association Property improvement.

(2) I asked them via a valid work order to have our fire extinguisher cabinets labeled here on Captain Nurse Circle and they said to “do it yourself.”

“The Board of Directors for Meadow Park has considered the cost and currently
allows homeowners interested in replacing stickers on fire extinguisher
boxes to do so themselves.”

This Board of Directors wants us to replace stickers? What stickers? There are no stickers to replace…That is the problem.. The stickers were never there in the first place. I do not have any stickers!! What a bunch of  stupid freaks these people are…These fire extinguisher cabinets were installed without proper labeling…Yet all of the other fire extinguisher cabinets in Meadow Park have this labeling! That is unfair treatment and puts our neighborhood at a higher risk for a fire emergency because people may panic when they do not know how to get that fire extinguisher out of the locked cabinet!! And they are trying to make me responsible for labeling these cabinets!


(3) I asked them to remove all the paperbark trees and eucalyptus trees here on Captain Nurse Circle and they referred me again to Fire Marshal Bill Tyler, who has recently said that there is “nothing wrong” with the vegetation here and Bill Tyler calls the paperbark trees “pepper trees”.

Ms. Angle,

Our office would like to refer you to Battalion Chief Bill Tyler’s March 17,
2015 e-mail:

“The existing condition of the landscape is substantially in compliance with
the existing approved vegetation management plan, given this time of the
year.”

We would also like to inform you that we are working closely with the
current landscape contractor and Novato Fire Department to ensure that
Meadow Park is properly maintained throughout the entire year.

This is the type of so-called “management” we have here in Meadow Park. They, (Wakefield Sharp) refer to a Fire Marshal who is not doing his job… This guy, Fire Marshal Bill Tyler from Novato Fire Protection District, is calling the paperbark bottle brush trees (which are all over the landscape here on Captain Nurse Circle) pepper trees!

What a scam artist! He just calls them pepper trees and shrugs it all off. He should be fired for doing such a rotten job of “protecting us” against a fire hazard…It feels like the Novato Fire Protection District is only trying to protect the fires, not the people…More fires mean they have a reason to exist. High fire hazards means fire fighters have jobs to fight fires…Maybe someone from a different industry needs to be in charge of this situation…Someone that does not have a reason to keep a landscape in a high fire hazard condition… 

This documentation is all I need to go further with a lawsuit against the Novato Fire Protection District, Wakefield Sharp, The City of Novato, and the Meadow Park HOA.

They will be hearing from my attorney very soon and this legal matter is now being escalated to the Marin County Courts… This prohibited vegetation was planted over 10 years ago without any regards to our Vegetation Management and Fuel Modification Plan, Phase One.

 

These people continue to act like this Plan does not exist! They seem to like the fact that Captain Nurse Circle remains at a high fire hazard risk… They certainly are not doing anything right to decrease the high fire hazard risk we all face as Owners here on Captain Nurse Circle…They seem to want us to have a fire hazard… Is that what is really going on? Maybe they should call themselves “Novato Anti-Fire District”…Maybe that is what we really need here in Novato…

Novato Fire Marshal Calls it a Pepper Tree- No Visit Ever Made On Site…

Six months ago, I made the following post… I just let it all go after that.. I could not believe that the Novato Fire Marshal was calling the high fire hazard trees (Australian Paper Bark) on my street” California Pepper” trees.. There was nothing else I could do… I just simply posted his email response and mine and said good bye to the Novato Fire Protection District… I could finally see that they are just a scam… But, I am putting this on the front page of my blog so others can see what I had to deal with and why I had to let it go… As of this date, the very bad rees remain here untouched… I still hope for the day when good people will take control and make my neighborhood safe from a major fire disaster… I do not care what the Fire Marshal says… I do not trust him..I only trust my own feelings and that has allowed me to live and be safe… And I will continue to post the truth about this situation until that day when everything is done right…

After receiving your complaint on March 12, 2015 the following actions have been taken by the Novato Fire District to investigate and follow up:

 

  1. Complaint was assigned to a NFD Fire Inspector Lynne Osgood who performed a preliminary site inspection, including but not limited to identifying the area of the tree and other landscaped vegetation that you captured in your submitted photo;

 

  1. Identified the type of tree, evaluated the arrangement of vegetation, and its proximity to the structure;

 

  1. Contacted the property management company  and arranged to meet with the new landscape maintenance supervisor;

 

Findings:

 

  1. The existing condition of the landscape is substantially in compliance with the existing approved vegetation management plan, given this time of the year.

 

  1. The tree in the photo is a Pepper Tree and is included on the list of approved fire resistive trees in the approved plant list. It was limbed up appropriately. It is not to be considered a fire hazard. I understand from you that it was removed— it was done so without our input or recommendation.

 

  1. We will continue to work with and educate the property manager and their landscape maintenance crews as to proper maintenance of the approved vegetation management plan.

 

I realize that you have strong opinions regarding the current state of the landscaping and up keep, and that those opinions may not be in alignment with our evaluation and findings. We will continue to work with the management to keep the residential areas fire safe, and thank you for your concerns, which we do take seriously.

Again, I want to say this one more time:

The tree in question was not a “Pepper tree”..A pepper tree has red berries and different leaves than this one… This tree was an Australian Paperbark tree. There are several of these paperbarks (bottle brush type) behind my  building.. Way too many…And all over Captain Nurse Circle

Now, I am not stupid. I know what kind of tree these are…. This is not the right kind of tree for our landscaping. These trees are not safe. They are highly invasive, non-native and high fire hazard and if anyone from the Fire Protection District actually would come out and see them, they would have to admit this too. I am really done with you guys this time..I know that no one ever really did come and see this stuff. All lip service….

You are not dealing with my reality. You have a mindset that is not healthy either… To say these are Pepper trees is very irresponsible of you..Shameful..

I do not want to continue to discuss this situation with you fire people.. I see that you guys do not take this very seriously…. My point here is this: the Novato Fire Protection District is a sham.. They do not come out and do any inspections here. They call the vegetation safe when it is not. They are not in touch with reality..They are not protecting anyone but themselves!

This is the tree in question. It is not a pepper tree. There are several of these paperbark trees right now everywhere on my street and the Novato Fire Marshal says it is OK and calls these pepper trees… What a joke!  I am posting this here so we can all get a good laugh at those fire people who just sit around and do nothing and wait for a fire to happen! These trees are just a few examples of the mess we have here on Captain Nurse Circle..

The State of California requires homeowners to have their fire sprinkler system inspections every five years! Yet, the Meadow Park Owners have not been informed about this.. There are some Owners who are blatantly ignoring this whole thing and thus continue to allow our community to be at a major fire hazard risk..

I am getting more involved with this inspection right now because I know it could drag on for many months… And the problem is that there has been poor communication from the beginning … This communication is the responsibility of the management company, Wakefield Sharp, to make it clear that this inspection is mandatory, not optional….

I have emailed the inspection company, Exxell Fire Systems, and the Novato Fire Marshal, B/C Bill Tyler, to make sure all are aware that the budget meeting coming up on March 17 must include a line item for fire sprinkler system repairs… I am sure there is nothing right now… But this line item needs to be added so we can all have our fire sprinkler systems repaired in a timely manner… I do not want this inspection to go on and on and on without any follow-up.. That could easily happen in this HOA where it is being led down the wrong road all the time….

Here is the email I sent to Nate at Exxell Fire Systems. I forwarded it to the Fire Marshal too .. I hope this helps ensure that this costly but important inspection continues and completes without further delay.

I am following up with you one more time because this fire sprinkler inspection is so important for our Meadow Park community. We are a ten-year old community and this inspection was never done here before!

Below is the agenda for the March Board of Director’s meeting on March 17 at 7 PM.. You can see that there is no mention of your company there. But they are discussing the budget for the upcoming year. I would recommend highly that you get in touch with the management company (Wakefield Sharp) ASAP and make sure you can be included in this agenda. Even if you are not completely done with all of the inspections, you must let them know how much the costs are going to be (an estimate is fine) to do the repairs. Otherwise, this HOA will put it off…Believe me, I know how they do things there…The repair costs need to be included in this new budget!

I know this sounds weird, but that is how they run things like this. So please let your management staff know that they really should be involved in this upcoming board of director’s meeting… Please do not be passive about this.. I want this inspection completed in a reasonable time. I have paid my HOA assessment fees regularly ($223.00/month) to have this done.. I hope you understand..The Owners are the real clients here. We are the ones who pay for this. And you guys will get paid sooner too if you push this a bit.. I know the management company, Wakefield Sharp,  is not used to having this inspection done for its HOA  clients.. They are very hesitant to make it easier for you..

I am here to make it as easy as possible. I am on your side.. Please do as I ask.. Let this happen the right way… Submit an estimate of repairs for the board of directors to consider at this next meeting… You will be so happy you did this!

I am the only one who pushed the HOA to get this inspection done. I have the Novato Fire Marshal,  B/C Bill Tyler, on my side.  You can always contact him too for help.. ( i.e. if there are negligent Owners who do not cooperate with this inspection!)..  His phone number is: 415-878-2690.
